A personal representative, also known as an executor, is a responsible individual appointed to oversee the distribution of the estate in compliance with the terms of the will.

Rhode Island Definition of a Will

“Will” shall extend to a testament and to a codicil and to an appointment by will, or by writing in the nature of a will, in exercise of a power.

Rhode Island Will Age Requirements

Age Requirements: Every person of sane mind and eighteen (18) years or older in age, may devise, bequeath, or dispose of, by his or her will, all real estate and all personal estate. (Rhode Island General Laws § 33-5-2)

Rhode Island Will Witness Requirements

Witness Requirements: The testator’s signature shall be made or acknowledged in the presence of two (2) or more witnesses present at the same time, and the witnesses shall attest and shall subscribe the will in the presence of the testator.

Revoking A Rhode Island Will

A will or codicil or any part thereof may be revoked except by another will or codicil executed in the same manner as the original will, or by some writing declaring an intention to revoke the will and executed in the manner in which a will is required to be executed, or by burning, tearing, or otherwise destroying the will by the testator, or by some person in his or her presence and by his or her direction, with the intention of revoking the will.
